Terms and Conditions
Welcome to the Kaiser BioSciences website located at https://kaiserbiosciences.com (the "Site"). These Terms and Conditions (the "Terms") govern your access to and use of this Site. By accessing and using this Site, you (“Buyer”) agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue immediately.
1. Use of Site and Products
1.1 Intended Use.
The Products offered for sale on this Site are intended for legitimate research and development purposes only. They are not intended for human or animal consumption, use as a drug, food drugs, food additives, cosmetics, or household application of any kind. PowerPeptides disclaims all liability for misuse and provides no instructions for usage. The Products are not intended to diagnose, cure, mitigate, treat or prevent any disease.
1.2 Age Restriction.
You must be at least 21 years old to access and/or purchase from this Site. By doing so, you represent and warrant that you are at least 21 years old.
1.3 Compliance with Laws.
You are responsible for ensuring compliance with all local, state, and federal laws concerning the purchase, handling, storage, and use of the Products. Kaiser BioSciences is not liable for any damages caused by the misuse of the products.
1.4 No Resale.
Products sold on this Site are for the Buyer's own research use only. Any resale or transfer of the products to third parties is strictly prohibited.
1.5 Toxic Substances Control Act.
Buyer is solely responsible for ensuring that the products purchased from Kaiser Peptides are approved for use under the Toxic Substances Control Act (TSCA), where applicable.
1.6 Product Verification.
If the Products purchased from Kaiser BioSciences are repackaged, relabeled, or used as starting materials or components of other products, the Buyer agrees to independently verify Kaiser BioSciences' assay results. Kaiser BioSciences assumes no liability for any downstream misuse, injury, or consequences incurred by the Buyer or third-party users.
2. Orders and Payment
2.1 We only service the United States
Please be aware that Kaiser BioSciences only services the United States, so any orders from outside the USA will be declined.
2.2 Accepted Payment Methods.
Credit card
All major credit cards are accepted.
2.3 Prices and Currencies.
Product prices are listed in U.S. Dollars. Prices are subject to change at any time. The Buyer is responsible for any applicable sales tax, import duties, and fees.
2.4 Order Acceptance.
Your order is not accepted until Kaiser BioSciences sends an order confirmation. Kaiser BioSciences reserves the right to refuse any order in its sole discretion.
2.5 Shipping.
Products are shipped by UPS whenever possible. Buyer is responsible for shipping costs unless specified. Kaiser BioSciences is not liable for shipping delays or damage that occurs during shipping.
3. Returns and Refunds
3.1 No Returns.
Due to the nature of the products sold on this Site, Kaiser BioSciences does not accept any returns under any circumstances. All purchases made through this Site are considered final and non-refundable or modifiable unless a purchase cannot be fulfilled. Kaiser BioSciences encourages all customers to review their orders carefully before completing a purchase.
4. Intellectual Property
4.1 Ownership.
The Site and its entire contents, features and functionality, including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection and arrangement, are owned by Kaiser BioSciences, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
4.2 Limited License.
You are granted a limited, non-transferable, non-exclusive, revocable license to access and use the Site for research-related purposes only. You may not copy, modify, distribute, or create derivative works from the Site content without written consent.
5. Third-party Content
This Site may include links to third-party websites. Kaiser BioSciences is not responsible for the content, policies, or availability of these external sites and disclaims all liability from their use.
6. Indemnity Waiver for Research Compounds
6.1 Waiver Agreement
In consideration of the purchase of research compounds from Kaiser BioSciences, I, the undersigned Buyer agree to indemnify, defend, and hold harmless Kaiser BioSciences, its officers, directors, contractors, employees, agents, and affiliates (hereinafter referred to as "Merchant") from any and all claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys' fees, arising from or related to the purchase, possession, or use of the research compounds.
I understand and acknowledge that the research compounds sold by Kaiser BioSciences are intended solely for research purposes and are not approved by the U.S. Food and Drug Administration (FDA) for human or animal use. I agree to use the compounds in accordance with all applicable laws and regulations and to take full responsibility for any risks associated with their purchase, possession, and use.
I release, discharge, and waive any claims, demands, causes of action, suits, judgments, and liabilities of any kind that may arise from or be connected to the purchase, possession, or use of the research compounds.
I further agree to defend, indemnify, and hold harmless Kaiser BioSciences against any claims, liabilities, damages, expenses, and losses, including but not limited to personal injury, property damage, or any other harm, whether direct or indirect, foreseeable or unforeseeable, resulting from or connected to the purchase, possession, or use of the research compounds.
This indemnity waiver applies to me, my affiliates, agents, my heirs, executors, administrators, successors, and assigns.
By purchasing research compounds from Kaiser BioSciences, I confirm that I have read and understood this Indemnity Waiver. I voluntarily agree to its terms and conditions.
6.2 Prohibited Conduct.
Buyer agrees that they may not post, review, or publicly attack Kaiser BioSciences with any false information about Kaiser BioSciences' products.
7. Disclaimer
DISCLAIMERS YOUR USE OF THE SITE, ITS CONTENT AND ANY PRODUCTS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT AND ANY PRODUCTS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER KAISER BIOSCIENCES NOR ANY PERSON ASSOCIATED WITH KAISER BIOSCIENCES MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE SITE OR USE OF THE PRODUCTS. WITHOUT LIMITING THE FOREGOING, NEITHER KAISER BIOSCIENCES NOR ANYONE ASSOCIATED WITH KAISER BIOSCIENCES REPRESENTS OR WARRANTS THAT THE SITE, ITS CONTENT OR ANY PRODUCTS OBTAINED THROUGH THE SITE WILL BE ACCURATE, RELIABLE, ERROR-FREE OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR THAT THE SITE OR ANY PRODUCTS OBTAINED THROUGH THE SITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.
TO THE FULLEST EXTENT PROVIDED BY LAW, KAISER BIOSCIENCES HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
7.1 LIMITATION OF LIABILITY.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KAISER BIOSCIENCES, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, CONRTACTORS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
8. Governing Law and Jurisdiction
8.1 Governing Law.
All matters relating to the Site and these Terms and any dispute or claim arising there from or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Texas without giving effect to any choice or conflict of law provision or rule.
8.2 Legal Expenses.
In the event of any legal dispute, the Buyer agrees to pay or promptly reimburse all of Kaiser BioSciences' expenses relating to attorneys' fees, filing fees, and any other expenses incurred in connection with the case.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. It's your responsibility to monitor changes to these Terms and Conditions.
By continuing to access or use our Site after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Site.
10. Entire Agreement
These Terms and our Privacy Policy constitute the sole and entire agreement between you and Kaiser BioSciences regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
THANKSGIVING REFERRAL PROMOTION — OFFICIAL RULES
PLEASE READ CAREFULLY! ALL REQUIREMENTS MUST BE MET TO QUALIFY.
1. MUST BE A TRUE NEW CUSTOMER — NO EXCEPTIONS!
The person you refer must be a BRAND-NEW CUSTOMER who has NEVER purchased from Kaiser Medical Management OR Kaiser BioSciences before.
Examples of referrals that DO NOT qualify:
An existing customer who creates a new account using a different name or email address.
Someone who previously purchased from KMM but is now ordering from Kaiser BioSciences for the first time, or vice versa.
Referring yourself or placing an order under another person's name to earn a gift code.
Using a spouse, family member, or household member to create a duplicate account or disguise an existing customer's purchase as a new customer's order.
IMPORTANT: KMM will verify all new-customer referrals. We may compare names, shipping addresses, email addresses, phone numbers, payment information, and previous order histories.
If the referred person has purchased from either company before, uses a duplicate account, or attempts to bypass the rules, THE REFERRAL IS INVALID AND NO GIFT CODE WILL BE ISSUED!
2. REFERRING CUSTOMER'S FULL NAME MUST BE ENTERED AT CHECKOUT!
The NEW customer MUST enter the referring customer's FULL NAME in the Referral/Comment section at checkout.
If the referring customer's full name is missing, incomplete, or not entered during checkout, the referral is INVALID AND NO CREDIT WILL BE GIVEN!
NO EXCEPTIONS. NO RETROACTIVE REFERRAL CREDIT.
3. ALL REFERRAL GIFT CODES EXPIRE DECEMBER 18, 2026!
All referral gift codes must be redeemed no later than December 18, 2026.
If the gift code is not used by that date, it will automatically expire.
NO EXTENSIONS OR REPLACEMENTS FOR EXPIRED CODES.
4. ONE-TIME USE — UNUSED GIFT CODE BALANCES ARE FORFEITED!
Each referral gift code can only be used toward ONE transaction.
For example:
If you receive a $150 gift code but your next order is only $100, the remaining $50 is FORFEITED.
You will NOT receive cash back, a refund, a new gift code, or store credit for any unused amount.
USE THE FULL VALUE OF YOUR GIFT CODE IN ONE PURCHASE OR LOSE THE REMAINING BALANCE!
5. AFFILIATES DO NOT QUALIFY!
Current KMM and Kaiser BioSciences affiliates, affiliate partners, and individuals participating in commission-based referral arrangements are NOT ELIGIBLE for this promotion.
6. ONE REFERRAL REWARD PER NEW CUSTOMER!
Only the new customer's FIRST qualifying purchase is eligible for a referral reward.
A new customer may list only ONE referring customer.
Future purchases made by that same customer will NOT generate additional referral rewards.
7. REFERRAL REWARDS ARE BASED ON NET PRODUCT PURCHASES!
Gift codes are calculated at 50% of the NEW customer's net product purchase amount.
Taxes, shipping charges, discounts, credits, and refunded amounts are NOT included when calculating the referral reward.
8. PURCHASE MUST BE COMPLETED AND VERIFIED!
Referral gift codes will only be issued after the new customer's payment and eligibility have been verified.
Canceled orders, refunded purchases, chargebacks, fraudulent transactions, and incomplete orders DO NOT QUALIFY.
If an order is later canceled, refunded, or disputed, KMM reserves the right to cancel or adjust the related referral reward.
9. REFERRAL GIFT CODES CANNOT BE COMBINED WITH OTHER PROMOTIONS!
Referral gift codes cannot be combined with other discount codes, promotional offers, affiliate benefits, or special pricing.
10. NO CASH VALUE OR TRANSFERS!
Referral gift codes cannot be exchanged for cash, transferred to another customer, resold, or applied to previous purchases.
11. KMM RESERVES THE RIGHT TO VERIFY ALL REFERRALS!
KMM reserves the right to verify customer eligibility, review purchase histories, investigate suspected duplicate accounts, and disqualify referrals that violate the published promotion rules.
All eligibility decisions will be based on the stated requirements of this promotion.
